Privacy Policy

RunScend ("RunScend", the "App", "we", "us", or "our") is operated by TSYBORG LLC, a Borg Mobile / TSYBORG venture. This Privacy Policy explains what information we collect when you use the RunScend mobile app and the runscendence.com website (together, the "Services"), how we use and share it, and the choices and rights you have.

By using the Services, you agree to this Privacy Policy. If you do not agree, please do not use the Services.

Who we are and how to contact us#

TSYBORG LLC is the controller of your personal information for the purposes of this policy. For any privacy question or request, contact us at [email protected].

Information we collect#

We collect the information needed to coach your running and run the Services. The categories below map to what you actually do in the App.

Account information#

When you create an account, we collect your name, email address, and a password (which we store only as a securely hashed value — we never store your plain password). We also store preferences such as your chosen coach personality, fitness level, and your acceptance of our waiver and terms.

Activity, location, and route data#

The core of RunScend is coaching your runs, so when you record a run we collect:

  • Precise location (GPS) during the run, including your route trace, used for distance, pacing, and turn-by-turn coaching.
  • Performance data such as pace, distance, duration, elevation, splits, and the points where your pace changed ("breakpoints").
  • How you felt — perceived effort and any feeling tags you add.

We also use your approximate location to retrieve local weather so your coach can adapt to conditions. Location is used while you run; the route and performance data are saved to your account so you (and your coach) can see your history.

Health and fitness data#

RunScend is a fitness app, so the data above is health and fitness information: your runs, pace, effort, heart rate (where you connect or enter it), training plans, and race goals. We use it only to coach you and improve your training, as described below.

Nutrition data (optional features)#

If you use nutrition features, we collect the meals and food photos you log and your nutrition targets. Food photos may be sent to an AI image-analysis provider to estimate the food and its nutrition (see "Third-party services"). We do not use your photos to identify you.

Audio#

RunScend plays audio coaching to you; ordinary use does not record you. If we offer voice-interaction features (such as asking your coach a question), the App will request microphone access and tell you before any audio is captured for that purpose.

Device and usage data#

Like most apps, we automatically collect technical data such as device type, operating system, app version, language, time zone, device identifiers, and diagnostic and crash logs, and basic usage information (for example, features used and session length) to keep the App working and improve it.

Purchases#

If you buy a subscription, the purchase is processed by Apple App Store or Google Play, not by us. We receive your subscription status (for example, whether you have an active Premium plan) but not your full payment-card details.

Website and communications#

On runscendence.com we use a single essential session cookie to keep you signed in to your dashboard. If you contact us or submit the contact form, we collect the name, email, and message you provide. The website does not use advertising cookies.

How we use your information#

We use your information to:

  • Provide the coaching service — generate your training plan, create your personalized audio coaching, pace and navigate your runs, and adapt your plan after each run.
  • Show your history — display your runs, stats, and progress in the app and on your web dashboard, and generate text briefings.
  • Operate and secure the Services — authenticate you, prevent abuse and fraud, and troubleshoot.
  • Improve the Services — understand how features are used and make them better.
  • Communicate with you — service messages, and (with any required consent) product updates you can opt out of.
  • Offer free and premium tiers — and, if we introduce an ad-supported free tier in the future, to serve ads (Premium would remain ad-free). We do not currently serve third-party ads.
  • Comply with law and enforce our Terms.

Where the GDPR or UK GDPR applies, we rely on these legal bases: performance of a contract (to provide the coaching you sign up for), your consent (for example, precise location, optional features, and marketing — which you can withdraw at any time), our legitimate interests (to secure and improve the Services), and legal obligation where applicable.

How we share your information#

We do not sell your personal information, and we do not share it for cross-context behavioral advertising in the sense defined by California law. We share information only as follows:

  • Service providers / processors who run the Services on our behalf (hosting, AI processing, maps, weather, analytics, and support), under contracts that limit their use of the data to providing those services. See "Third-party services".
  • App stores (Apple, Google) for distribution and to process purchases.
  • Advertising partnersonly if and when we introduce an ad-supported free tier (Premium would be ad-free). We do not currently share data with advertising partners; if that changes, we will update this policy and, where required, obtain consent and honor opt-outs.
  • Legal and safety — to comply with law, respond to lawful requests, or protect the rights, safety, and property of users, the public, or us.
  • Business transfers — if we are involved in a merger, acquisition, or sale of assets, your information may be transferred, subject to this policy.

Third-party services we rely on#

To deliver coaching we use a small set of reputable providers, each of which may process limited data:

  • Cloudflare — hosting, our database, and storage (your account and run data are stored here).
  • AI/ML API gateway (providing Google Gemini and OpenAI text-to-speech) — to generate your coaching scripts, the synthesized coach voice, and, if you use nutrition features, to analyze food photos. Relevant run context or photos are sent for processing.
  • Mapbox — maps and routing for run navigation.
  • OpenWeatherMap — weather for your approximate location.
  • Apple App Store / Google Play — distribution and purchases.

Each provider processes data under its own privacy terms and our agreements with them.

Data retention#

We keep your personal information for as long as your account is active and as needed to provide the Services. If you delete your account, we delete your personal data associated with it, except where we must retain limited information to comply with legal obligations, resolve disputes, or enforce our agreements. Backup copies are deleted on a rolling schedule.

Security#

We protect your information with measures including encryption in transit (HTTPS/TLS), hashed passwords, and access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we work to protect your data and to address issues promptly.

Your rights and choices#

Depending on where you live, you may have the right to access, correct, delete, or export your personal information, to object to or restrict certain processing, and to withdraw consent.

  • Delete your account and data: you can delete your account and its data directly in the App (Settings → account), or by emailing [email protected]. Account deletion removes your runs and personal data, subject to the retention exceptions above.
  • Location: you can turn off precise location in your device settings, though this will limit run tracking and navigation.
  • Marketing: you can opt out of marketing messages at any time.

We will not discriminate against you for exercising these rights. To make a request, email [email protected]; we may need to verify your identity first.

EEA/UK#

You may lodge a complaint with your local data protection authority. If we transfer your data outside your region, we rely on appropriate safeguards such as Standard Contractual Clauses.

California#

California residents have rights under the CCPA/CPRA, including to know, delete, correct, and opt out of "sale" or "sharing." We do not sell your personal information. You may exercise these rights via the contacts above.

Location and precise data controls#

RunScend needs precise location to track your route and provide turn-by-turn coaching, and approximate location for weather. You control location permissions in your device settings and can revoke them at any time; some features will not work without them.

Children's privacy#

The Services are not directed to children under 13 (or the minimum age required in your country, if higher), and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact [email protected] and we will delete it.

International data transfers#

We operate globally and may process and store your information in the United States and other countries via our providers (including Cloudflare's global network). Where required, we use appropriate safeguards for these transfers.

RunScend provides fitness coaching, not medical advice. Information in the Services is for general fitness purposes and is not a substitute for professional medical guidance. See our Terms & Conditions for important health and safety terms.

Changes to this policy#

We may update this Privacy Policy from time to time. We will post the updated version here with a new "Last updated" date and, where appropriate, notify you in the App. Your continued use of the Services after changes take effect means you accept the updated policy.
